These Terms & Conditions (“Terms”) govern your access to and use of costcutterpackaging.com (the “Site”) and your purchase of products and services from Cost Cutter Packaging (“Cost Cutter Packaging,” “we,” “us,” or “our”). By using the Site, requesting a quote, or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or place an order.

1. Eligibility

Our products and services are intended for businesses and for individuals who are at least 18 years old and able to enter into a binding contract. By ordering, you confirm that you meet these requirements and that any information you provide is accurate.

2. Quotes and Orders

Quotes we provide are estimates based on the specifications you give us and are valid for 14 days unless stated otherwise. A quote does not reserve production capacity or guarantee pricing after it expires. An order becomes binding only when we accept it and, where required, you have approved the final artwork and made any required payment. We may decline or cancel an order at our discretion, for example if a product is mis-priced, specifications are unclear, or we suspect fraud.

3. Pricing and Payment

Prices are stated in US dollars unless noted otherwise and exclude taxes, duties, and shipping unless expressly included. You are responsible for any applicable sales tax, duties, or similar charges. We may require full payment or a deposit before production begins. Our price-match promise, where offered, applies only to comparable specifications and may require documentation; final eligibility is at our reasonable discretion.

4. Artwork, Proofs, and Approval

You are responsible for reviewing and approving the final artwork or proof before production. Once you approve it, production proceeds based on that approved version, and we are not responsible for errors it contains, including typos, layout, color specified by you, or incorrect dimensions you supplied. If you ask us to proceed without a proof, you accept the associated risk. Please review proofs carefully, as they are your final opportunity to catch mistakes.

5. Your Artwork and Intellectual Property

You retain ownership of the artwork, logos, and content you provide, and you grant us a limited license to use them solely to produce and fulfill your order. You represent and warrant that you own or have the right to use everything you submit, and that it does not infringe any third party’s intellectual property or other rights. You agree to indemnify and hold us harmless from any claim arising out of the content you provide. All Site content, including text, graphics, and design created by us, is owned by or licensed to Cost Cutter Packaging and may not be copied or reused without permission.

6. Production and Turnaround

Production and turnaround times are estimates and typically begin after you approve the final artwork and complete any required payment. We work to meet estimated timelines, but we are not liable for delays caused by factors outside our reasonable control, including supply issues, carrier delays, incomplete or late approvals, or force majeure events.

7. Manufacturing Tolerances

Quantity tolerance. Custom printing and manufacturing can produce slight overruns or underruns. We may deliver and invoice within a tolerance of plus or minus 5 percent of the ordered quantity, and this is considered a complete order.

Color and material variation. Because of the nature of printing and natural materials, slight variations in color, finish, and material between screen, proof, and final product, or between production runs, are normal and are not considered defects.

8. Shipping and Delivery

Shipping timelines are estimates and are governed by our Shipping Policy, which is incorporated into these Terms. Unless stated otherwise, risk of loss passes to you once the product is handed to the carrier. Free first-order shipping, where offered, applies to eligible new-customer orders shipped within the United States and Canada.

9. Custom Products, Cancellations, and Returns

Our products are custom made to your specifications. Because of this, orders generally cannot be cancelled once production has begun, and custom products are not returnable or refundable except where they are defective or do not match your approved specifications. If there is a problem with your order, contact us within 7 days of delivery with your order details and photographs. Where a claim is valid, our responsibility is limited to reprinting, replacing, or refunding the affected portion of the order, at our option.

10. Samples

Sample kits let you evaluate our materials and finishes before ordering. Where offered, the cost of a sample kit may be credited toward your first qualifying order, subject to any conditions we state at the time.

11. Warranties and Disclaimers

We warrant that products will substantially conform to the specifications you approved. Except as expressly stated, and to the fullest extent permitted by law, the Site, products, and services are provided “as is” and we disclaim all other warranties, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

12. Limitation of Liability

To the fullest extent permitted by law, Cost Cutter Packaging will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to your use of the Site or products. Our total liability for any claim will not exceed the amount you paid for the order giving rise to the claim. Some jurisdictions do not allow these limitations, so they may not fully apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Cost Cutter Packaging and its officers, employees, and agents from any claims, damages, losses, and expenses, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the Site, or the content and specifications you provide.

14. Governing Law and Disputes

These Terms are governed by the laws, without regard to conflict-of-law rules. Any dispute will be resolved in the courts, unless the parties agree otherwise.

15. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above shows when. Changes take effect when posted, and your continued use of the Site or placing of a new order means you accept the updated Terms.
